Description of Property: Hotel known as the Embassy Suites by Hilton, Washington DC, Chevy Chase Pavillion and believed to contain 198 guestrooms, 7 meeting rooms, 1 indoor pool and a fitness center.  Substitute Trustee does not warrant the accuracy of the foregoing description. 

By virtue of a certain Deed of Trust, Assignment of Leases and Rents, Security Agreement and Fixture Filing from AREPII CC Hotel, LLC to Chris Luckett, Trustee dated January 9, 2018 and recorded among the Land Records of the District of Columbia (the “Land Records”) on January 10, 2018 as Instrument No. 2018003733, securing PCCP Credit IX REIT-SUB HOLDCO, LLC in the amount of $44,883,000.00; as affected by Re-Recording Certification recorded January 25, 2018 as Instrument No. 2018008436; as further affected by Re-Recording Certification recorded February 12, 2018 as Instrument No. 2018015410; as affected by Assignment of Deed of Trust, Assignment of Leases and Rents, Security Agreement and Fixture Filing recorded May 9, 2018 as Instrument No. 2018046298 (collectively, the “Deed of Trust”), together with that certain UCC Financing Statement from Borrower securing Lender, recorded on January 10, 2018 as Instrument No. 2018003735; as affected by UCC Financing Statement Amendment recorded February 12, 2018 as Instrument No. 2018015395; as further affected by UCC Financing Statement Amendment recorded May 11, 2018 as Instrument No. 2018047322; and as continued by UCC Financing Statement Continuation recorded August 15, 2022 as Instrument No. 2022085588 in aforesaid records (all of the foregoing are collectively, as amended and/or modified, the “Security Instruments”), and at the request of the party secured thereby (the “Noteholder”), a default having occurred in the payment of the indebtedness secured thereby and the covenants contained therein,  and in accordance with Public Law 90-566 and following the mailing of a Notice of Foreclosure Sale of Real Property or Condominium Unit recorded and Affidavit of Non-Residential Mortgage Foreclosure, both of which were recorded among the Land Records on February 11, 2025 as Instrument Nos. 2025014673 and 2025014674, respectively, and the recordation of a Deed of Appointment of  Substitute Trustee recorded among the Land Records on February 11, 2025 as Instrument No. 2025014672 the undersigned Substitute Trustee, will sell, at public auction, within the office of ALEX COOPER AUCTIONEERS, INC., 4910 MASSACHUSETTS AVENUE, N.W., SUITE 100,  WASHINGTON, D.C. 20016 on THURSDAY, MARCH 27, 2025 AT 11:00 AM.

the following described land and premises (the “Real Estate”):  All that certain land located in the District of Columbia known as Square 1661 Lot 0031 a/r/t/a 2008 and being more particularly described as follows: 

Lot 2008 (being part of Lot 31 per plat recorded in Book 212 at page 183 of the Office of the Surveyor for the District of Columbia) in Square 1661, more particularly described as Condominium Unit C-3 in CHEVY CHASE PAVILION COMMERCIAL CONDOMINIUM (hereinafter called the "Condominium") which was constituted and established under the District of Columbia Condominium Act of 1976, as amended, by the Condominium Declaration dated November 6, 2017 and recorded December 28, 2017 as Instrument No. 2017142135 in the Office of the Recorder of Deeds of the District of Columbia (hereinafter called the "Condominium Declaration"), and by the Bylaws dated November 6, 2017 and recorded December 28, 2017 as Instrument No. 2017142136 in the Office of the Recorder of Deeds of the District of Columbia (hereinafter called the "Condominium Bylaws"), and by the Plat and Plans of Condominium Subdivision recorded December 28, 2017 in Condominium Book 98 at Page 42 in the Office of the Surveyor of the District of Columbia (hereinafter called the "Condominium Plat and Plans"). Condominium Unit C-3 is also defined and known as the Hotel Unit in the Condominium Declaration, Condominium Bylaws and Condominium Plat and Plans.

TOGETHER with all of the appurtenances incident to said Condominium Unit as contained in the Condominium Declaration.

SUBJECT, HOWEVER, TO all covenants, conditions, restrictions and other matters of record.

The Condominium Declaration allocates to the Condominium Unit an undivided interest (stated as a percentage) in the common elements of the Condominium (hereinafter called the "Percentage Interest"). The Percentage Interest of the Condominium Unit is set forth in Exhibit B to the Condominium Declaration.

TOGETHER WITH any and all buildings, structures, improvements or appurtenances now erected on the above-described land, including, without limitation, all equipment, apparatus, machinery and fixtures of any kind or character forming a part of said buildings, structures, improvements or appurtenances, and any furniture, furnishings, equipment, machinery and other personal property owned and located in, upon or about the above-described land and any buildings thereon all as more particularly described in the aforesaid Deed of Trust (collectively, the “Property”).

FIXTURES AND TANGIBLE PROPERTY

Pursuant to the Deed of Trust as evidenced by the aforementioned Security Instruments recorded among the Land Records and upon occurrence of a default thereunder, the Noteholder, as the holder of a security interest and lien on all of the tangible and intangible assets of the Debtor, will sell at public auction on the same date and at the same time and place, ALL OF THE FURNITURE, FIXTURES, EQUIPMENT and TANGIBLE PROPERTY, ETC. of the Debtor located on or about the Real Estate (that is subject to the security interest and lien of Noteholder and not owned by any third party.)
